TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to all memberships, classes, private and semi-private training sessions, block bookings, seminars, nutritional coaching and other services provided by Funxion Junxion (“FJ”, “we”, “us” or “our”).
By purchasing a membership, booking a session, attending a class, using our facilities or equipment, or otherwise participating in activities provided by FJ, you confirm that you have read, understood and agreed to these Terms.
These Terms replace all previous terms and conditions issued by FJ.
1. Definitions
For the purposes of these Terms:
“Membership” means an FJ membership providing access to the classes or other services included within the relevant membership package.
“Class” means a scheduled group training session provided by FJ.
“Private Training” means individual 1-to-1 personal training.
“Semi-Private Training” means small-group personal training arranged with an FJ coach.
“Block Booking” means a prepaid package of classes or training sessions with a specified number of sessions and an expiry date.
“Session” means a Private Training or Semi-Private Training appointment.
“Member” means an individual who purchases or uses an FJ Membership or other FJ service.
2. Memberships and Purchases
All Memberships, Private Training Sessions and Block Bookings must be paid for in advance unless otherwise agreed with FJ.
Memberships, Private Training Sessions and Block Bookings are non-transferable and, except where required by law or expressly stated in these Terms, are non-refundable and cannot be exchanged for alternative services.
A Membership provides access only to the services and number of Classes specified in the Membership purchased.
Private Training and Semi-Private Training are separate services and are not included in a Membership unless expressly stated otherwise.
By selecting “Place Order” or otherwise completing a purchase, you confirm that you have read and accepted these Terms.
3. Rolling Memberships
All FJ Memberships are rolling memberships with no minimum contractual term.
Memberships begin on the date specified at the time of purchase and automatically renew on a recurring basis until cancelled in accordance with these Terms.
Unless otherwise stated, monthly Memberships renew on the same calendar day each month as the original Membership start date.
For example, a Membership commencing on 11 January will ordinarily renew on the 11th of each subsequent month.
Where a Membership is based on weekly periods, the relevant membership week runs from Monday to Sunday.
Failure to attend Classes does not suspend or cancel a Membership and does not remove the obligation to pay Membership fees.
4. Membership Cancellation
Members may cancel a rolling Membership by providing 30 days' notice.
Cancellation requests should be submitted to FJ in writing by email to info@fjgym.co.uk.
The 30-day notice period begins when FJ receives the cancellation request.
Membership access will continue during the applicable notice period, and normal Membership payments will remain due during that period.
Where a payment date falls within the 30-day notice period, that payment will remain due.
Once the 30-day notice period has expired, the Membership will end and no further recurring Membership payments will be taken.
Cancelling a Membership does not automatically cancel any separately booked Private Training, Semi-Private Training, Classes or Block Bookings. Those services remain subject to their respective cancellation and expiry terms.
5. Membership Rates
Membership rates may be reviewed from time to time.
Where FJ proposes to change the price of an existing rolling Membership, we will provide reasonable advance notice of the new price.
If you do not wish to continue your Membership at the new price, you may cancel your Membership in accordance with the 30-day cancellation procedure set out in these Terms.
6. Class Cancellation Policy
There is a strict 12-hour cancellation policy for Classes.
If a Class booking is cancelled with less than 12 hours' notice, or if the Member does not attend, a £5 late-cancellation/no-show charge will apply.
FJ may waive this charge at its discretion in exceptional circumstances.
7. Block Bookings
Each Block Booking has a stated expiry date.
The expiry date applies to all sessions included within the Block Booking and cannot ordinarily be extended.
Any sessions remaining unused when the Block Booking expires will be forfeited.
Sessions cancelled within 12 hours of the scheduled start time, or not attended, will be treated as used and will not be reinstated.
Block Bookings are non-transferable.
8. Private and Semi-Private Training
There is a strict 24-hour cancellation policy for Private and Semi-Private Training Sessions.
If a confirmed Session is cancelled with less than 24 hours' notice, or the Member does not attend, the Session may be forfeited and the applicable late-cancellation charge will apply.
The applicable charges are:
Private Training: £70
Semi-Private Training: £35
These charges compensate the coach for reserved time that cannot reasonably be reallocated.
Where a Session is cancelled with at least 24 hours' notice, the Member should contact their coach directly to arrange an alternative appointment.
For Semi-Private Training, if an individual Member is unable to attend a scheduled session, that Member is responsible for arranging a make-up session with their coach. Any make-up Private Training Session will be charged at the applicable rate.
9. Session Expiry
Unless otherwise stated at the time of purchase, Private and Semi-Private Training Sessions must be used within one month of purchase.
Where a Block Booking has a specific expiry date, that expiry date takes precedence.
Once the applicable expiry date has passed, unused Sessions will expire and cannot ordinarily be carried forward.
10. Booking and Confirmation
Requests for Private or Semi-Private Training made through the FJ website are requests only and are not considered confirmed until they have been confirmed by an FJ coach.
Members should not assume that a booking is confirmed until confirmation has been received.
This is particularly important for bookings made at short notice or outside normal operating hours.
11. Late Arrival
Members should arrive at least five minutes before the scheduled start of a Class or Session.
Members arriving more than five minutes late for a Class may be refused entry where the coach considers that allowing entry would disrupt the Class or compromise safety.
Members arriving more than 15 minutes late for a Private or Semi-Private Training Session may be treated as having cancelled the Session, and the applicable cancellation policy may apply.
Late arrival does not ordinarily extend the scheduled end time of a Session.
12. Conduct and Behaviour
FJ is committed to providing a safe, respectful and productive training environment for all Members.
Members must:
Sign in to every Class they attend.
Notify reception or FJ staff immediately if they are unable to sign in.
Follow all reasonable instructions given by coaches and staff.
Follow the FJ House Rules and applicable health and safety requirements.
Treat coaches, staff and other Members respectfully.
Avoid behaviour that interferes with coaching, training or the safety or enjoyment of other Members.
Talking during coaching instructions, deliberately disrupting a Class, disrespectful behaviour towards a coach or other Members, or conduct that compromises safety may result in the Member being asked to leave the Class or facility.
FJ may suspend or terminate a Membership or other service where a Member seriously or repeatedly breaches these requirements.
13. Class Participation and Safety
Participation in group Classes is subject to the reasonable discretion of the FJ coaching team.
If a coach reasonably considers that a Member cannot safely participate in a particular Class or exercise, FJ may require the Member to modify an exercise, cease participation in that activity, or undertake Private Training instead.
This is a safety measure and does not constitute medical advice or a medical diagnosis.
14. Supplemental Training and Mobility
Members may undertake supplemental skill training and/or mobility work for up to 10 minutes before or after a Class, subject to the following conditions:
Supplemental training must not interfere with a Class, Private Training or Semi-Private Training Session.
Classes and Private Training take priority over supplemental training.
Equipment must not be used in a way that obstructs or interferes with scheduled training.
The lead coach may require supplemental training to stop at any time where they consider this necessary for safety, space, equipment or operational reasons.
Barbell weightlifting is not permitted during supplemental training periods unless expressly authorised by an FJ coach.
Members must not conduct independent workouts at FJ outside the permitted supplemental-training periods unless expressly authorised by FJ.
15. Membership Freeze / Hold Policy
Memberships may, at FJ's discretion, be temporarily placed on hold to accommodate serious illness or injury.
Trial Memberships cannot be placed on hold.
To request a Membership hold, the Member must email info@fjgym.co.uk at least 7 days before the requested start date and provide the requested hold dates.
The following conditions apply:
The minimum hold period is four weeks.
The maximum hold period is three months.
Holds cannot be applied retrospectively.
Extensions to an existing hold will be treated as a new hold for administrative purposes.
A hold may be ended early by the Member by contacting FJ.
At the end of the agreed hold period, the Membership will automatically reactivate and normal payments will resume.
If the maximum three-month hold period is reached and the Member does not contact FJ to reactivate or otherwise resolve the Membership, FJ may treat the Membership as cancelled.
16. Billing and Failed Payments
Members are responsible for ensuring that their payment and billing information remains accurate and up to date.
If a payment fails, including because a card has expired, been cancelled, replaced or is otherwise invalid, the Member must provide updated payment information within 14 days.
FJ may suspend access to Membership services while payments remain outstanding.
Where a payment remains outstanding after 14 days, FJ may charge a £20 administration fee, where permitted by applicable law.
FJ may use another valid payment method that the Member has provided and authorised for payment where the original payment method fails.
If a Member repeatedly fails to make payments when due, FJ may suspend or terminate the Membership.
Termination for non-payment does not remove any payment obligation that has already accrued.
17. Changes, Cancellations and Rescheduling by FJ
FJ may occasionally need to change, cancel or reschedule Classes or Sessions because of holidays, special events, staffing requirements, maintenance, operational requirements or other circumstances.
Where reasonably practicable, FJ will provide advance notice of material schedule changes.
Where FJ cancels a paid Class or Session, FJ will, where appropriate, provide a replacement booking, credit or other appropriate remedy.
Nothing in these Terms excludes or limits any rights or remedies available to Members under applicable law.
18. Membership Benefits
Subject to the terms of the applicable Membership, Members may:
Attend Classes up to the number permitted by their Membership.
Participate in Classes subject to the reasonable assessment of the coaching team and applicable safety requirements.
Undertake permitted supplemental skill training and mobility work before or after Classes in accordance with these Terms.
Membership does not provide unrestricted use of the FJ facility, equipment or training areas outside the services included in the relevant Membership.
19. Health and Medical Conditions
Exercise, strength training, cardiovascular training, mobility work and other physical activities involve inherent risks, including the risk of injury.
Members are responsible for informing FJ honestly and accurately about any health condition, injury, medication, medical history or other circumstance that may affect their ability to exercise safely.
Members should seek appropriate medical advice before participating where they have concerns about whether exercise is suitable for them.
FJ coaches are not medical professionals and FJ does not provide medical diagnosis, treatment or medical advice.
Information provided by a Member regarding their health is used to help FJ assess appropriate participation and exercise limitations.
Members must immediately inform a coach if they experience pain, dizziness, unusual shortness of breath, illness or any other concerning symptom during exercise.
20. Assumption of Exercise Risks
By participating in FJ activities, the Member acknowledges that physical exercise involves inherent risks, including muscle soreness, strains, sprains, falls and other injuries.
FJ will take reasonable steps to provide a safe training environment and appropriate instruction. However, exercise cannot be made completely risk-free.
Members are responsible for exercising within their own capabilities and for following reasonable instructions given by FJ coaches.
21. Liability
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under English law, including liability for death or personal injury caused by negligence.
To the extent permitted by law, FJ will not be responsible for loss or damage arising from a Member's failure to follow reasonable instructions, failure to disclose relevant health information, or participation beyond their known physical capabilities.
Nothing in these Terms affects any statutory rights or remedies available to the Member.
22. Use of Facilities and Equipment
Members must use FJ equipment and facilities responsibly and in accordance with instructions provided by FJ coaches or staff.
Members must not use equipment in a manner that is unsafe, unauthorised or likely to damage the equipment or endanger another person.
Any damage caused by a Member's deliberate or negligent misuse of FJ property may result in the Member being responsible for reasonable repair or replacement costs, to the extent permitted by law.
23. Suspension or Termination by FJ
FJ may suspend or terminate a Membership or refuse access to Classes or Sessions where reasonably necessary for:
Health and safety reasons;
Serious or repeated breaches of these Terms or the House Rules;
Abusive, threatening or seriously disruptive behaviour;
Repeated non-payment; or
Other serious circumstances affecting the safe or proper operation of FJ.
Where FJ terminates a Membership for reasons other than the Member's breach of these Terms, FJ will consider an appropriate refund or alternative remedy for any prepaid services that have not been provided, subject to applicable law.
24. Refunds and Credits
Except where otherwise stated in these Terms or required by law, payments for Memberships, Classes, Private Training, Semi-Private Training and Block Bookings are non-refundable.
Credits, replacement Sessions or refunds are not automatically available for missed Classes or Sessions.
Nothing in this section affects a Member's statutory rights where FJ has failed to provide a service in accordance with applicable law.
25. House Rules
Members must comply with the FJ House Rules, as amended from time to time.
The House Rules form part of these Terms.
FJ may take reasonable steps to enforce the House Rules where necessary to maintain a safe, respectful and effective training environment.
26. Changes to These Terms
FJ may update these Terms from time to time to reflect changes to our services, facilities, operational requirements or applicable law.
Where a change materially affects an existing Membership or contractual commitment, FJ will provide reasonable notice.
Changes will not retrospectively alter rights or obligations that have already accrued.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Nothing in these Terms affects any mandatory rights or protections available to consumers under applicable law.
